Terms & Conditions
These Terms & Conditions govern your access to and use of Gastro (the “App”). By accessing or using the App, you agree to these Terms. If you do not agree, do not use the App.
1. About Gastro
Gastro is a restaurant discovery application that helps users find restaurants and view information such as names, categories, ratings, approximate location, photos, contact methods, and similar business details. Gastro is provided for informational purposes only.
2. No Reservations or Transactions
Gastro does not process restaurant reservations, food orders, or payments unless explicitly stated in a future version of the App. Any interaction, communication, or transaction between you and a restaurant or third party is solely between you and that business or third party.
3. Third-Party Content and Data Sources
Some content displayed in Gastro may be provided by third-party services, including Google Maps Platform and related services. This may include business names, business descriptions, photos, addresses, operating hours, ratings, reviews, phone numbers, websites, map content, coordinates, and similar place-related information.
Gastro does not own or control third-party content and does not guarantee that such content is accurate, complete, current, available, or fit for any particular purpose.
4. Accuracy of Information
Restaurant information can change at any time. Menus, pricing, schedules, availability, contact details, and other business information may be incomplete, outdated, or incorrect. You are responsible for verifying important information directly with the restaurant before relying on it.
5. Google Maps Platform Notices
Certain content made available through the App may be subject to additional third-party terms and policies, including Google Maps Platform terms, attribution requirements, and content usage restrictions. Use of that content through Gastro remains subject to any applicable third-party requirements.
6. Permitted Use
You may use Gastro only for lawful, personal, and internal purposes related to discovering restaurants and related information. You agree not to:
- copy, scrape, harvest, or extract content from the App in bulk;
- reverse engineer, interfere with, or disrupt the App or its backend services;
- use the App in violation of applicable law or third-party rights;
- misuse any map, place, or restaurant data made available through the App.
7. Intellectual Property
Gastro, including its software, branding, layout, original text, and original design elements, is owned by or licensed to its operator and is protected by applicable intellectual property laws. Third-party trademarks, business names, images, reviews, maps, and other third-party content remain the property of their respective owners.
8. Availability of the App
Gastro may be modified, updated, suspended, or discontinued at any time, with or without notice. We do not guarantee that the App will always be available, uninterrupted, secure, or error-free.
9. Disclaimer of Warranties
To the maximum extent permitted by applicable law, Gastro is provided on an “as is” and “as available” basis, without warranties of any kind, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.
10. Limitation of Liability
To the maximum extent permitted by applicable law, Gastro and its owner, operator, affiliates, contractors, and service providers shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of data, revenue, profits, goodwill, business opportunity, or business interruption, arising out of or related to your use of, or inability to use, the App.
To the maximum extent permitted by applicable law, Gastro shall also not be responsible for inaccuracies in third-party content, business closures, changes to restaurant offerings, or any issue arising from your visit to, communication with, or reliance on information about a restaurant or third party.
11. Indemnity
You agree to defend, indemnify, and hold harmless Gastro and its owner, operator, affiliates, contractors, and service providers from and against any claims, liabilities, damages, judgments, losses, and expenses arising out of or related to your misuse of the App, your violation of these Terms, or your violation of any law or third-party right.
12. Privacy
Your use of the App is also subject to the Gastro Privacy Policy.
13. Changes to These Terms
We may update these Terms from time to time. The updated version will be posted with a revised “Last updated” date. Your continued use of the App after changes become effective constitutes acceptance of the updated Terms.
14. Governing Law
These Terms shall be governed by and interpreted in accordance with the laws of Costa Rica, without regard to conflict of law principles, unless applicable law requires otherwise.
